Artist Terms (v1.0)
These terms apply when an artist registers a work on OPUS, the authenticated digital art edition platform. By submitting a work, the artist is deemed to have accepted these terms v1.0.
1. Scope
These terms apply to every work the artist registers, publishes, or sells on OPUS. Absent a separate written agreement, these terms together with the OPUS Terms of Use and Privacy Policy take precedence.
2. Rights Warranty (Artist's Primary Responsibility)
By registering a work on OPUS, the artist warrants the following:
- The artist is the copyright owner of the work, or holds (or has been duly delegated) every right necessary to register, publish, and sell the work (including assignments or licences of copyright, neighboring rights, character / brand IP licences, etc.).
- If any identifiable person (model, cosplayer, etc.) appears in the work, the artist holds explicit consent from every such person.
- If any model is a minor, the artist holds explicit consent from the legal guardian as well.
- If costumes, figures, characters, or other third-party IP are depicted, the artist has reviewed the rights-holder guideline and is registering the work within the scope that permits paid distribution.
- The work itself, and its depiction, does not violate applicable laws, including the Japanese Penal Code, the Act on the Welfare of Children, and the Adult Entertainment Business Act.
Primary legal responsibility for clearing all rights, including civil and criminal liability, rests with the artist. OPUS relies on the artist's attestations absent a credible report; the burden of evidence in a dispute lies with the artist.
3. OPUS Actions and Indemnification
Upon receipt of a rights infringement report, or where reasonable suspicion exists even without a report, OPUS may promptly take any of the following actions:
- De-listing or removal of the work
- Suspension of payment or payout processing
- Temporary or permanent suspension of the artist's account
- Provisional measures under the Japanese Provider Liability Limitation Act, the Korean Information and Communications Network Act, or any other applicable law
OPUS aims to send a first response within 7 business days of receipt. If the artist suffers loss as a result of such actions and the report was reasonable on its face, OPUS bears no liability. Where OPUS pays damages to a third party arising from infringement, OPUS may seek full indemnification from the artist.
4. Withdrawal Policy
The artist may withdraw a registration as follows:
- Pending review or changes requested: the artist may withdraw immediately.
- Approved but unsold: the artist may file a withdrawal request stating reasons; an operator will review for legitimacy and approve. (This flow is enabled via a separate operational rollout.)
- Sold works: the artist cannot unilaterally withdraw. For objective causes (rights infringement, court order, withdrawal of model consent, etc.), contact OPUS support to arrange a case-by-case resolution.
The Chronicle ledger entry (withdrawn) for a retracted work is permanently retained for audit purposes and hidden from public surfaces.
5. Model and Subject Rights (Photo-Genre Specifics)
Photography depicting identifiable people, including portraits and cosplay, must additionally comply with the following:
- The artist must retain explicit written (including messaged) consent from each model.
- If a model later withdraws consent to their likeness, OPUS may promptly de-list or remove the affected work.
- Do not submit model identifying information (real name, contact, or other PII) to OPUS. In a dispute, OPUS may ask the artist directly to produce the original consent evidence.
6. Indemnification
If the artist's representations are inaccurate, or the artist breaches these terms and OPUS, another artist, a collector, or any third party suffers loss, the artist shall defend and resolve the matter at the artist's own cost and shall fully indemnify OPUS.
7. Changes
These terms are v1.0. Material changes will be announced in advance via the footer link and the artist console. Significant changes may require artist re-consent.
8. Governing Law and Jurisdiction
Disputes concerning the interpretation or performance of these terms shall be submitted to the court with jurisdiction over the registered office of the OPUS operating entity as the exclusive court of first instance. Upon transition to a Japanese operating entity, Japanese law and Japanese courts shall apply with priority.
